HWL Ebsworth has acted for Austin Engineering Limited in obtaining an interlocutory injunction in the Federal Court of Australia against a former employee who has subsequently worked for a competitor, the Schlam Engineering Group. The injunction was based on allegations of infringement of copyright and misuse of confidential information.
Various entities in the Schlam Engineering Group were also respondents in the Court proceedings in respect of Norwich Pharmacal orders, which were contested by them. The Court found in favour of Austin and ordered the Schlam entities to provide the Norwich Pharmacal information to Austin, by affidavit.
A Norwich Pharmacal order is an order for disclosure of information which is beyond usual preliminary discovery rules of Court.
The proceedings continue.
