HWLE property team contributes to redrafting of NSW Contract for the Sale and Purchase of Land

HWLE Partner Gary Newton and Special Counsel Maged Jebeile have contributed to the redrafting of the NSW Contract for the Sale and Purchase of Land (Contract), a critical document for property owners in NSW. Newton and Jebeile sit on the Property Committee of the Law Society of NSW, which published the new Contract in March.

The 2026 Contract is now available to purchase and should be used in all NSW land sale contracts. The main change considers a new prescribed form of cooling off notice, which must be used in all contracts that are entered into and all exchanges made. If this does not occur, the purchaser has the right to walk away for the first two weeks after the contract date and receives a full refund of their deposit. If the new form is not used after 31 May 2026, buyers may escape a property sale if the seller has used the outdated 2022 edition.
