This week’s Super Alert reports on ASIC’s draft whistleblower policy guidance and the ATO’s update in relation to regulatory changes announced in the Federal Budget.

ASIC releases draft whistleblower policy guidance

On 7 August 2019, ASIC released a consultation paper and draft regulatory guide in relation to “proposed guidance for entities that must have a whistleblower policy…[such as] proprietary companies that are trustees of registrable superannuation entities”.

According to ASIC, the regulatory guide “will help these entities establish, implement and maintain a whistleblower policy that complies with their obligations under the revised corporate sector whistleblowing regime in Pt 9.4AAA of the Corporations Act”.

Submissions to the draft regulatory guide close on 18 September 2019.

ATO update on changes announced in Federal Budget

On 13 August 2019, the ATO released a list of “proposed changes to tax and superannuation legislation and policy” which were announced as part of the 2019-20 Federal Budget on 2 April 2019. In relation to each change, the ATO has specified the start date which was proposed as part of the Federal Budget, along with the current developments in relation to that proposal.
