Brian Rom

Brian is a disputes lawyer specialising in complex construction matters. He has significant experience in high value arbitrations, court proceedings, expert determinations, adjudications and mediations – always underpinned by a prudent legal strategy. His disputes experience extends to oil and gas, renewables, shipping, mining, logistics, property and fraud matters. In addition, he has substantial construction contract drafting experience.

Brian is a regular speaker on construction law and general contract related topics.

He has practiced in the UK, South Africa, New South Wales and Victoria. Prior to moving to Australia in 2008, he worked in London for eight years on multi-jurisdictional arbitrations and court proceedings.

Experience

Brian’s experience includes acting for the following clients:

  • Contractor in respect of multi-million-dollar claims concerning delay, disruption and direct costs in respect of a government hospital;
  • Design joint venture in respect of $1.5 million in claims for variations (50) and construction phase services claims (1200);
  • Engineering company defending multi-million-dollar claim by a local council and builder in respect of alleged design errors;
  • Barge operator in claim by major oil company in a claim involving vessel design;
  • State-owned oil company in an arbitration involving claims for US $80 million arising from termination of FPSO charter contract; and
  • Wind-farm installation contactor in relation to adjudication claims by subcontractors.
