The ATO released various publications about trust distributions on 23 February 2022. The publications have been over three decades in the making(!).
Overall, the ATO takes a strict view on certain aspects of the law. Most high net worth individuals, wealthy family groups and private clients could, in one way or another, be distributing trust income in a way that puts them in the ATO’s “red zone”, possibly prompting review or audit action.
