Session 2 - Managing ill and injured employees in the workplace

Bede Gahan and Andrew Allan will discuss:

  • the importance of supporting the mental health of workers;
  • dealing with uncooperative behaviours of ill and injured employees;
  • redeployment, reclassification and termination, including for the non-performance of duties and for employees whose redeployment prospects are limited (such as lower classifications);
  • practical tips for managing and resolving complex cases, including in relation to employees whose ongoing employment is no longer viable; and
  • recent case law examples of good and bad management of mental health at work.

Session 3 - Legal professional privilege

Session 4 - Technology Contracts - Maximising Outcomes and Managing Risk

In 2018-19 Australian Government expenditure on ICT related goods and services was over $3.9 billion. More broadly, the majority of Commonwealth commercial contracts involve some form of technology. Maximising outcomes and managing risks in technology contracting is integral to the core functioning of Australian Government agencies, and to effectively achieving program objectives. Technology contracts may involve simple procurements, (such as sourcing commercial off-the-shelf products), or the procurement of bespoke technology solutions, complex systems integration services or Defence capabilities.

Justin Bernau and Yuban Moodley will cover:

  • navigating the multi-vendor environment in sourcing ICT related goods and services, including key procurement and contract structuring issues;
  • managing risks in developing and negotiating complex technology-based contracts; and
  • maximising outcomes through effective contract management.

Session 5 - Contractual Liability: Indemnities, limitations and exclusions

Contractual liability is one of the most important and frequently negotiated issues in government contracts. In this session, Toby Mittelman will look at the operation of key terms which regulate contractual liability such as indemnities, limitations and exclusion clauses, the way these issues are addressed in Commonwealth government contracts and the ways in which contractors frequently seek to negotiate them.

Session 6 - Limitation periods - What are the implications for Commonwealth clients?

Michael Palfrey and Stephen Coyle will look at the different approaches to limitation periods in the jurisdictions relevant to Commonwealth clients. They will discuss how to determine limitation periods and the effect they have on different types of proceedings. Case studies will be used to highlight the differences across jurisdictions.
