Rebecca Jaffe

Rebecca acts for a range of banking and financial services organisations providing advice on the application and interpretation of the Competition and Consumer Act, AFCA, National Credit Code and Banking Code of Conduct, especially as it applies to securities enforcement.

Rebecca also has a broader commercial litigation practice including acting for regulators with a focus on the application of the Corporations Act and ASIC Act.

An experienced negotiator, Rebecca regularly represents clients in both pre-litigation and court orders mediations.

Experience

Rebecca’s experience includes advising:

  • A wide range of lenders to enforce or defend claims regarding their security which often involve mortgages, share mortgages, guarantees and GSAs;
  • A regulator in a Federal Court Proceeding concerning alleged breaches of continuous disclosure obligations under the Corporations Act 2001;
  • Financial services clients defending claims of negligence and breach of statutory duties in the provision of financial advice; and
  • A property developer regarding the enforceability of an alleged contract of sale in the Supreme Court of Victoria and on Appeal (successfully).
