Paul Graham

Paul specialises in dispute resolution with a focus on construction matters and prides himself on “knowing the client’s business and providing accurate, timely legal advice which meets the client’s budget and commercial requirements”. He has appeared as advocate in numerous mediations, arbitrations and litigation in Australia, England and Asia.

After four years at the Victorian Bar, Paul moved to work in Thailand and as indicated in Asia Pacific Legal 500, has advised clients on a number of projects in the region including Bangkok’s new airport and on contentious matters arising from Bangkok’s largest wastewater project.

Paul joined HWL Ebsworth in August 2008 and is a Partner in the Melbourne Building and Construction Group. Paul is a co-author of Victorian Pleading Precedents 1997 and is admitted to practise in Victoria, England and Wales and Hong Kong.

  • Acted for numerous contractors/owners/consultants in SOP claims in Australia – adjudications, County Court and Supreme Court including:
    • 470 St Kilda Rd Pty Ltd v Reed Constructions Pty Ltd [2012] VSC 235;
    • Best Balustrades Pty Ltd v APM Group (AUST) Pty Ltd [2014] VCC 1659;
    • Krongold Constructions (Aust) Pty Ltd v SR & RS Wales Pty Ltd [2016] VSC 94; and
    • MKA Bowen Investments Pty Ltd v Carelli Constructions Pty Ltd [2019] VSC 436.
  • John Holland on several projects, including:
    • $10 million dispute on Velodrome/MSAC
    • $7 million dispute with PTV on Westall Project
    • $5.4 million dispute with Structerre Consulting Engineers
  • NOSS consortium (comprising Veolia and United Utilities) in Bangkok arbitration claim (circa £100M) regarding wastewater network and treatment plant in central Bangkok;
  • US entity on issues arising from its subcontract to Exxon in the PNG LNG project;
  • ITO JV in dispute with Bangkok Government regarding  Suvarnabhumi airport;
  • A liquidator of mining contractor in AUD$20M dispute regarding a gold mine in WA;
  • A major subcontractors to H2JV on Ararat Prison PPP Project in Victoria;
  • A micro-tunnelling subcontractor in its claims on the Victorian Desalination Project; and
  • A contractor in Supreme Court dispute regarding the Otway Gas Project.
