Neil Perl

Neil specialises in commercial and corporate dispute resolution and insolvency.

Neil has a broad range of experience assisting clients in respect of asset recovery, shareholder disputes, corporations, contract, trade practices, property and fraud related disputes and litigation. Neil provides clients with strategic advice to effectively manage litigation risks and resolve disputes commercially and efficiently. Neil regularly advises clients in relation to regulatory compliance and investigations, including investigations by the Australian Securities & Investments Commission.

In the area of insolvency and restructuring, Neil acts for insolvency practitioners on all aspects of voluntary administrations, liquidations, receiverships and is experienced advising financiers, companies and directors dealing with financial distress and insolvency situations.

Experience

Neil’s experience includes advising:

  • Confidential public company director in regards to defending prosecution of charges for ‘insider trading’ under the Corporations Act 2001 (Cth) and subsequent proceedings under the Proceeds of Crime Act 2002 (Cth);
  • Confidential property developer in regards to defending a Supreme Court of Victoria proceeding concerning breach of director’s duties, breach of contract and complex constructive trust and tracing claims in relation to a property development joint venture;
  • Koko Black Group as the administrators and subsequent liquidators of the Koko Black Group of companies on various aspects of the administration and liquidation, including prosecuting proceedings in the Supreme Court of Victoria to obtain freezing orders in relation to a former employee;
  • Various clients, for liquidators and creditors, in connection with liquidator recovery claims including unfair preferences, un-commercial transactions and other voidable transactions and claims; and
  • Various clients in relation to investigations by the Australian Securities & Investments Commission, including responding to statutory production notices and representation at ASIC examinations.
