Kyle Somann-Crawford

Kyle specialises in securities enforcement, personal and corporate insolvency and commercial dispute resolution.

Kyle assists a number of major Australian banks, state and regional banks, mortgage originators and lenders by providing focused and strategic representation and advice on enforcement issues arising in respect to secured and unsecured lending.

He also acts on behalf of and advises liquidators, trustees in bankruptcy, creditors, large and small corporate entities in respect to all aspects of the personal and corporate insolvency landscape and the resolution of commercial disputes.

Experience

Kyle’s recent experience includes advising:

  • My State Financial Limited in relation to a principle carriage of the Federal Court of Australia matter of Van der Kooij v MyState Financial Limited [2014] FCA 350. Where he successfully defended a claim against a lender who was sued by borrower seeking in excess of $2 million in damages for its refusal to accept a promissory note rendered pursuant to the Bills of Exchange Act 1909 (Cth);
  • Municipal Association of Victoria in the successful appeal before the Full Court of the Supreme Court of Tasmania in Latrobe Council v Williams [2007] TASSC 77;
  • Owner of large number of commercial properties on instructing a solicitor in the successful appeal of the determination by the Commissioner of State Revenue with respect to land tax;
  • Trustee in bankruptcy and liquidators on insolvency practitioners on the enforcement of policies of insurance where indemnity has been refused; and
  • Government business enterprises and private companies on a number of creditors who have been the subject of voidable preference claims arising from the liquidation of the Gunns Group of Companies.
