Kurt Wildermuth is a Special Counsel in HWL Ebsworth Lawyers’ Construction and Infrastructure Team.
Kurt has extensive experience advising governments, principals, contractors, subcontractors, engineers and consultants across Australia. His practice spans the full project lifecycle and includes major real estate developments, transport and social infrastructure, energy (including renewables) and utilities.
He advises on all forms of project delivery models, including procurement strategies, and is experienced in preparing and negotiating all types of construction contracts and ancillary project documentation.
Kurt also supports clients throughout project delivery, helping to avoid and resolve disputes, including prosecuting and defending complex security of payment adjudications and litigation.
Having also worked in-house with tier-one contractors and consultants, Kurt brings unique commercial insight and a practical understanding of client operations and structures, enabling him to deliver timely, strategic, and commercially focused legal solutions.
He holds a Master of Construction of Law from the University of Melbourne.

- TIER-1 CONTRACTOR – POWER PROJECT Advised a tier-1 contractor on multiple tenders with major electricity transmission network operators for the supply, design, installation and construction of transmission lines, substations and Battery Energy Storage Systems (BESS).
- TIER-1 CONTRACTOR – INDUSTRIAL & POWER GENERATION Advised a tier-1 contractor on multiple tenders with global energy companies for the provision of maintenance services and design and construction works at various mining sites in Queensland and Western Australia.
- TIER-1 CONTRACTOR – TRANSPORT Advised a tier-1 contractor on multiple tenders with local government and airport operators for the design, construction and maintenance of roads, taxilanes and taxiway infrastructure.
- PRIVATE PROPERTY DEVELOPER Advised a private property developer on a major residential real estate development on the Gold Coast, including preparing and negotiating the design and construct contracts and ancillary agreements.
- Private healthcare operator Advised a private healthcare operator on a significant aged care development on the Gold Coast, including advising on procurement strategy and preparing and negotiating the project documentation.
- STATE HEALTH AUTHORITY Advised on multiple major hospital upgrade projects including preparing and negotiating early contractor involvement contracts, design and construct contracts, and construct only contracts.
- COLLABORATIVE CONTRACTING Advised principals and head-contractors on significant projects involving collaborative contracting, including preparing and negotiating project documentation for alliancing, early contractor involvement, incentivised target cost and hybrid models.
- PROJECT DELIVERY Advised principals and head-contractors on project delivery as part of the project delivery team, including assistance with preparing, responding to and managing contractual claims, and supporting the early identification and resolution of disputes.
- SECURITY OF PAYMENT ADJUDICATIONS Acted on large, complex adjudications under Security of Payment legislation ranging from A$1 million to $30M in Queensland, New South Wales, Victoria and Northern Territory, including advice on payment claims, payment schedules, applications, responses and judicial review.
- ALTERNATIVE DISPUTE RESOLUTION AND LITGIATION Advised on alternative dispute resolution and litigation, including prosecuting and defending litigation in various courts and tribunals, including in respect of payment, defective works and professional duties.
