Konrad Anderson

Konrad is an experienced front-end construction and infrastructure lawyer who has acted across a full range of infrastructure sectors, including: defence; health; international aid; housing; mining; energy, (including wind, solar and gas); industrial developments; water (including desalination and sewerage); and transport (including rail, airports and roads).

Konrad acts for a wide range of clients in both the public and private sectors, including: government agencies; utilities; infrastructure owners; sponsors; developers; financiers; contractors and consultants. He specialises in providing strategic advice on project structuring; packaging; procurement; delivery models and risk allocation.

Konrad has vast experience advising on tendering, negotiation, drafting and project delivery using all forms of contracting (including PPP/project financed projects, EPC, D&C, construct-only, managing contractor, supply and install, O&M and consultancy/project management). He is particularly passionate about collaborative and innovative delivery models (including early contractor involvement and the use of integrated project teams) and dispute avoidance.

  • Department of Defence
  • National Airfields Works Program – Advice, drafting and continuous support in relation to the ECI, construction and design contracts, as well as associated procurement documentation for this program of projects to resurface end-of-life aircraft pavements, replace associated lighting and address drainage issues at selected Defence airfields around Australia;
  • Riverina Redevelopment Programme – Provision of a full range of procurement and drafting advice in relation to a program of works that covers three separate Defence base projects across the Riverina Region; and
  • Littoral Manoeuvre Program – Acting for the Department of Defence on a 10-year $5-7 billion program across numerous sites nationally, involving infrastructure to be delivered under a range of delivery models, potentially including PPPs, build-to-lease, managing contractor and ECI.
  • CSIRO: Australian Centre for Disease Preparedness – Advice on development of a specific ECI delivery model in which novation of the designer at the end of the design phase is required, so that the ECI construction contractor provides a full fitness for purpose wrap for upgrade works at this Biosafety Level-4 disease diagnosis and research laboratory, and drafting the ECI, D&C and designer contracts;
  • Government of Dubai: Dubai Strategic Sewerage Tunnel PPP – Strategic procurement advice and drafting of the concession agreements, EPC term sheets, O&M term sheets and tender documentation for a USD 22 billion project (under four separate DBFOM/DBF packages) to build and operate two modern gravity-fed deep wastewater tunnels and associated pump stations and link sewers, as part of Dubai’s 2040 Urban Master Plan.
  • Sponsors: Shuweihat S1 Independent Water and Power Plant Project (Abu Dhabi) – Advice on sponsors’ bid for an amended and restated power and water purchase agreement for this plant, including (in co-operation with financiers) drafting departures to the concession agreement and drafting and negotiating EPC and O&M contracts with preferred contractors;
  • Sponsors: Lobito-Lau Railway Corridor Project (Angola) – Drafting and advising sponsors on an EPC contract to pass down an existing concession agreement between the Government of Angola and the sponsors for the refurbishment, upgrade and operation of the railway, two new freight transit terminals and related infrastructure as well as the use of the Port of Lobito mining terminal in Angola to provide for the efficient transport of critical minerals and passengers from DRC and Zambia;
  • Sponsors: Golden Plans Wind Farm (Stage 1) – Drafting and advising sponsors on the drafting and negotiation of an EPC contract for the delivery of the first stage of a wind farm that will generate over 4000 GWh per annum of electricity;
  • Australia Pacific Airports: Advice on the drafting of the T2 Redevelopment Program managing contractor contract, the negotiation and drafting of the construct only contract for the Melbourne Airport T2 Arrivals Hall Redevelopment Project, the negotiation and drafting of the supply and installation contract for the New Baggage Handling System Project and legal issues relating to the realignment of the third runway at Melbourne Airport;
  • Fortescue Metals: Advice on the negotiation and drafting of numerous supply and supply and installation contracts for the development of the Iron Bridge iron ore mine and supporting infrastructure; and
  • TasNetworks: Development of a suite of template procurement and contract documents for the full spectrum of delivery models for the design, construction, operation and maintenance of the TasNetworks electricity network. Konrad also assisted in the implementation of the documentation on a number of projects, as well as facilitating various contract training workshops.
