Kevin Lock

Kevin has over 20 years’ senior legal experience in the construction & infrastructure and energy & resources sectors for domestic and internatonal projects including as General Counsel of an ASX listed oil and gas company and as General Counsel and Head of Legal of infrastructure development companies.

Kevin is commercially focussed and passionate about the delivery of complex projects across a broad range of contracting models including:

  • PPP/ project financed projects, Early Contractor Involvment (ECI), development agreements, managing contractor (MC), EPC, D&C, construct only, supply & install, O&M, project management, technical and consultancy services;
  • tendering and procurement for principals and contractors in numerous significant projects; and
  • contract drafting and negotiations: tailored contracts, standard form amendments, flow-down arrangements.

Kevin has an honours degree in engineering and a postgraduate qualification in construction law.  He enjoys engagement with stakeholders and working collaboratively in goal-oriented teams. He quickly grasps and interprets difficult concepts and adds value by providing innovative, interest-based solutions.

Experience

Kevin’s experience includes:

  • US Defence Fuel Storage Facility – advising the contractor on an innovative integrated EPC/ EPCM delivery model for a substantial fuel storage facility required by the US Government including contract drafting and negotiations and project delivery claims advice;
  • Energy Infrastructure EPC – advising a tenderer on EPC contract departures and negotiations for the development of wharf, airfield, roads and other civil works as part of an international LNG project;
  • PNG Ports Redevelopment – advising a tenderer on a Project Management Supervision Consultant (PMSC) contract for development of PNG ports;
  • Solar Power EPC – advising a contractor in respect of solar farms and battery energy storage systems in Australia, including EPC contract negotiations and claims;
  • Rooftop Solar – advising a national shopping centre owner on the installation, operation and maintenance of rooftop solar PV systems, including DCOM and PPA delivery models;
  • Energy – advising an international energy company on joint venture operations, sale and purchase (SPA’s), farmin/ farmout, offshore seismic acquisition and processing, offshore drilling campaigns, FPSO’s, production services and offtake, subsea development, regulatory requirements;
  • Water and Waste Water – advising Veolia and Mubadala on water and waste-water infrastructure projects across the Middle East and North Africa, including joint venture agreements and operations, project financed Build Own Operate (BOO), Design Build Operate (DBO) concessions, EPC, O&M and management contracts;
  • Penola Pulp Mill – advising a private developer for a project financed zero liquid discharge pulp mill including EPC, O&M, supply contracts, offtake, logistics and enabling legislation;
  • North East Link PPP – advising the Spark D&C joint venture on the incentivised target cost ($A11.1b) road tunnel project including its significant subcontract procurement program;
  • Defence Fuel Transformation Program – advising Defence on its (A$6b) fuel procurement program including O&M, asset management, inventory management and fuel supply;
  • Royal Melbourne Hospital – advising Melbourne Health on construction and procurement projects in accordance with the Victorian Government procurement guidelines;
  • Angau Hospital – advising the contract administrator for an international hospital project in respect of significant delay claims;
  • Samoa Legislative Assembly Office – advising the principal in the administration of contractor claims;
  • Mornington Peninsula Shire Council – advising MPSC to develop long term maintenance contracts across multiple asset types/ packages on a whole of government basis;
  • New York University Abu Dhabi PPP – advising the Abu Dhabi Government in respect of the (US$1b capex) campus including Project Agreement, D&C, O&M, fitout works, project financed district cooling plant, joint venture governance and stakeholder engagement;
  • EastLink PPP – advising Thiess John Holland on the (A$2.5b capex) D&C component and subcontracts;
  • Mobile Data Network (MDN) PPP and Metropolitan Mobile Radio (MMR) PPP – advising Motorola on project delivery including negotiating successful claims outcomes with the Victorian Government;
  • Waterfront City – advising ING in respect of D&C and EPC contracts for the significant mixed use development including Southern Star;
  • Plant & Equipment – advising on the supply and installation of plant and equipment including acceptance/ commissioning requirements and performance guarantees;
  • Rail – advising the Victorian Government on rail and rolling stock projects.
