David Joughin

David is a passionate financial services lawyer, with a particular focus on retail banking and financial services.  His extensive in-house and private practice experience gives him a unique understanding of commercial and regulatory drivers that sit behind a successful retail bank, including the importance of delivering practical and effective legal and compliance solutions to stakeholders that puts their customers first.

His significant experience includes engaging with and providing advice to a range of stakeholders on retail financial services legislation and regulation, advising on projects and reforms (including the implementation of new products and regulatory regimes (including UCT, BCOP, COBPCOP, CPS230 and CPS234, etc).  David has experience advising a range of clients who sit outside of traditional financial services on the impact of financial service regimes on their products and offerings and on privacy legislation.

Experience

David’s experience includes advising:

  • major and non-major bank clients on the implementation of changes to ensure compliance with the unfair contract terms regimes, BCOP and COBCOP updates;
  • on the implementation of new (and changed) deposit and credit products;
  • on the application of the financial services regime under Corporations Act and National Consumer Credit Protection Act to their product offerings and fundraising;
  • on transferring entity in $23B mutual ADI ‘merger of equals’, acted as the internal legal lead on this; and
  • on uplift programs across their supplier agreements for CPS230, CPS231 and CPS234 compliance.
