David Arribas

David has over 10 years of experience acting for, and on instructions from, Australia’s largest and most well known life insurance and general insurance companies in a broad range of claims and legal proceedings in Victoria.

David has particular expertise in advising on and defending total and permanent disablement, income protection, trauma and death benefit claims.

In addition, David has also represented many individuals and companies in a wide variety of commercial litigation in all Victorian courts and tribunals.

David is a member of the Victoria committee of the Australian Insurance Law Association, and a volunteer with the Diverse Women’s Mentoring Association.

Experience

David’s experience includes advising:

  • Life insurers and superannuation trustees on total and permanent disablement, income protection, trauma and death benefit claims. This includes everything from small quantum total and permanent disablement claims to million dollar claims involving complex issues of insurance policy interpretation and the application of the Insurance Contracts Act 1984 (Cth) (particularly regarding non disclosure and misrepresentation defences);
  • Professionals (accountants, financial advisers, architects) in claims made against them on instructions from their professional indemnity insurer. This includes claims against accountants for negligent advice regarding the purchase of a business, negligence in the review of a prospectus issued by a community bank, and misleading statements about the shareholder position of a company;
  • Insurers and companies on multi million dollar product liability and recall claims. This includes claims concerning food products manufactured and imported from overseas; and
  • Companies on multi million dollar commercial litigation. This includes claims concerning breaches of contract and the duty to negotiate an agreement in good faith.
