Craig McIver

For nearly 30 years, as both a solicitor and barrister, Craig has worked almost exclusively in the field of commercial and financial insurance.

Craig acts for and advises international and national underwriters on difficult indemnity issues involving financial lines, directors’ and officers’ liability, professional indemnity and other associated risks. Craig provides the strategic direction and commercial acumen necessary to deliver strong results to underwriters in policy analysis and response, coverage and monitoring roles.

Craig also holds significant experience as defence counsel in major insured disputes in all mainland Australian states and at a Federal level, involving key actors within the legal, financial, mining, property and construction industries.

Experience

Craig’s experience includes advising:

  • Primary and excess underwriters across a wide variety of insurance programs and industry sectors. His advice regularly addresses policy operation in connection with claims and notifications concerning major class actions, regulatory investigations and prosecutions, customer-based remediation programs and shareholder proceedings;
  • Directors and officers of a publicly listed services company about the robust defence of an array of regulatory and statutory investigations and compensation claims arising after the financial collapse of the company;
  • Public sector agencies in regards to statutory investigations imposed by the state-based official corruption watch-dog. This work involved addressing and resolving complaints about allegedly offensive conduct within the agency;
  • D&O insurance underwriters about strategy, risk management, policy operation and recovery opportunities connected to official investigations, inquests and regulatory responses to significant tragedies and losses; and
  • Primary and excess underwriters of indemnity and liability insurance programs in connection with major investigations and prosecutions by the anti-money laundering and counter terrorism funding regulator, along with associated investigations and civil suits.
