Alana Hewish

Alana’s experience is in all aspects of front-end and back-end construction and administrative law. She has prepared and defended complex payment claims made under Security of Payment legislation in Queensland and in litigation arising from adjudications.

Alana drafts and advises on all forms of construction and infrastructure procurement models and documentation, including design and construct agreements, consultant agreements, subcontracts, alliance agreements, construction management agreements, along with associated tender documentation and contract administration advice.

Alana is commercially minded and seeks to understand client objectives in each matter in which she acts. She is currently studying a Master of Construction Law at the University of Melbourne and is a member of the IAQ 2032 Games Taskforce.

Experience

Alana’s experience includes advising:

  • High Rise and Large Scale Residential: Acting for some of Australia’s largest private and publicly listed developers in various projects around Queensland, including recently drafting the contract for a residential tower in Brisbane for a high-profile developer and a residential/hotel tower on the Gold Coast;
  • A leading international mining group on various projects in Queensland and the Northern Territory, as well as in Arizona, USA;
  • Security of Payment: Acting for principals, head contractors and subcontractors in respect to claims under the Building Industry Fairness (Security of Payment Act) 2017, including the preparation of payment claims, payment schedules, the conduct of adjudications, the issue and defence of subcontractors’ charges and consequent court proceedings to enforce determinations or to have determinations set aside;
  • Government/ Building Regulation: Advising the Queensland regulator in all aspects of its business including in respect to administrative review, standard contracts for residential work, licensing, and non-conforming building products; and
  • A Tier 1 Contractor defending claims made by subcontractors in several adjudications regarding a large infrastructure project in Brisbane.
