Don Munro

Don Munro has extensive experience in health law, specialising in medical negligence claims. Don has represented both doctors and hospitals in hundreds of litigated claims since the 1980’s, some of which have reached the High Court. He understands how the health system operates and the demands placed on general practitioners, specialists and allied health professionals. He understands the stresses and strains that litigation brings to the medical profession.

Don has practised in all 3 Eastern States and the Australian Capital Territory.

Don frequently appears without counsel at mediations involving cerebral palsy and brain damages claims. Don also regularly appears in Court and has been actively involved in the development of the Professional Negligence List in the NSW Supreme Court.

Don has been named Best Lawyers™ Australia for Health & Aged Care Law and Medical Negligence. Additionally, Don was named “Lawyer of the Year” for Health & Aged Care in Best Lawyers™ Australia 2011 edition and Medical Negligence in Best Lawyers™ Australia 2013 and 2019 editions.

Don has been listed in the Doyle’s Legal Guide in the Leading tier of the ‘Leading Medical Negligence Lawyers (Defendant) – Sydney, 2015’.

Experience

Don’s experience includes advising:

  • Defending a general practitioner in a High Court claim for his alleged failure to refer an obese patient to a bariatric surgeon;
  • Defending a neurosurgeon where the High Court determined scope of duty under the NSW Civil Liability Act; and
  • Acting for two neurologists in a two week hearing by a former patient alleging that they failed to diagnose intracranial hypotension. The matter is currently undergoing a retrial following a successful appeal by the plaintiff.
