Daniel Kiley
Daniel specialises in intellectual property, information technology, and privacy, data protection and cybersecurity.
Daniel assists businesses with clearing, registering, protecting and commercialising IP, and managing international portfolios of trade marks, patents, registered designs, business names and domain names. He also assists clients from a wide range of industries with meeting their obligations under the Privacy Act and Australian Privacy Principles (APPs), including mandatory data breach notification requirements.
With a background in IT, Daniel also regularly assists clients with software licensing and cloud service agreements, and cybersecurity obligations including under the Security of Critical Infrastructure Act.
Daniel is a member and former chair of the Intellectual Property Society of Australia and New Zealand (IPSANZ) South Australian committee. He is also a member of the International Association of Privacy Professionals (IAPP).
In addition to his legal experience, Daniel holds a Bachelor of Mathematical and Computer Sciences, and has previously worked in the IT industry for an ASX-listed software consulting firm. He remains active in the industry, having released a number of his own iPhone and iPad apps. With this background, Daniel enjoys assisting businesses with issues related to technology, and data protection, such as software licensing and cloud service agreements, and cybersecurity obligations including under the Security of Critical Infrastructure Act.
Daniel is recognised by Doyle’s Guide as a leading lawyer in respect of both Intellectual Property Law and Technology, Media and Telecommunications Law, having previously been named a Rising Star in Intellectual Property, Technology, Media and Telecommunications Law nationally by Doyle’s Guide in 2016, 2017, 2018 and 2019. In 2013, Daniel received a South Australian Young Achiever Award in the ‘Online Achievement’ category.

Daniel’s experience includes advising:
- The SA Government in relation to the $1.605 billion commercialisation of the State’s lands titling and valuation services, including with respect to intellectual property, software, data and privacy issues;
- A leading consumer goods business on an international trade mark dispute involving trade mark applications, oppositions and revocation proceedings in over 30 territories;
- A top consumer smartphone app in managing its global brand portfolio;
- A large social services provider in relation to multiple data breach events involving personal information about a significant number of individuals;
- A connected autonomous vehicle technology company with its licensing and commercialisation arrangements;
- A System of National Significance software licensing and cloud service agreements, and cybersecurity obligations including under the Security of Critical Infrastructure Act;
- Screen funding bodies in preparing suites of documentation for feature films; and
- Codan Ltd in relation to the acquisition of Canadian-based radio technology business Daniels Electronics, and US-based technology company Domo Tactical Communications.
