Our legal services encompass the whole project lifecycle from conception, procurement and negotiation through to contract administration, risk management and all forms of dispute resolution. Our experience

  • Sydney Metro Projects Advising bidders on major Central and Western Tunnelling Packages as well as train supply operation and maintenance; Advising on the delivery and O&M phases of Sydney Metro Projects; advising on multiple stakeholder interface arrangements.
  • Griffith University Providing advice on the proposed vertical campus facility in Brisbane CBD and on commercial and legal drivers as the project transformed from Construct & Occupy to Lease & Occupy. Then advising on ECI D&C delivery of the major fit out of a heritage listed building.
  • Spark DC JV – North East Link Advising the D&C JV on the Primary Package during bid phase to contract close in 2021 and during the development phase on the $14+ billion North East Link Project – the largest road project in Victorian history, and comprising a PPP framework with collaborative contracting elements including an incentivised target cost regime.
  • Snowy Hydro 2.0 – Voith Hydro GmbH & Co. KG Advising on all aspects of the $12 billion Snowy 2.0 Reset project for Voith Hydro. Acting in integrated transaction document negotiations with the Contractor, Future Generation JV and Snowy Hydro Limited including the EPC/Turnkey Subcontract and Tripartite Agreements to successfully transition the project from an EPC payment profile into one which utilises an incentivised target cost model.
  • John Holland Advising John Holland in respect of the circa $200m Supreme Court litigation against the State of Western Australia regarding the construction of the Perth Children’s Hospital, including claims regarding defects, variations, liquidated damages and return of security.
  • Transport for NSW Advising on the procurement and delivery of asset management services for the M6 Stage 1 Motorway, a 30 year road tunnel asset operations and management agreement. HWLE’s services included the negotiation and drafting of complex transaction documents.
