Andrew Allan
Andrew is an expert dispute resolution lawyer and works primarily in common law-based insurance schemes and administrative benefit and review schemes.
Andrew’s clients include private insurers (including medical indemnity insurers), the Commonwealth Government, and the ACT Government.
Andrew is also an expert in migration law and assists businesses and individuals with Australian visa applications.
Andrew has twice been recognised as ‘Lawyer of the Year’ in Canberra in Best Lawyers TM Australia – for Alternative Dispute Resolution in the 2023 edition and for Insurance in 2022. He has been recognised in the same publication for Government Practice (2017 – 2024), Insurance (2019 – 2024) and Dispute Resolution (2020 – 2024).
Experience
Andrew’s experience includes:
- Acting for general insurers in respect of personal injury, property damage, product liability and medical negligence claims in the Australian Capital Territory and New South Wales courts. These claims typically involve allegations of negligence, breach of contract or breach of statutory duty.
- Acting for the ACT Government, Commonwealth government departments and agencies, and licensed self-insurers, in respect of claims made under the Safety, Rehabilitation and Compensation Act 1988 (SRC Act). Andrew manages litigation in the Administrative Appeals Tribunal and the Federal Court. Andrew specialises in claims of serious psychological injury, aggravation of pre-existing degenerative conditions, and claims that involve complex medical, causation and employment issues.
- Acting for the Department of Finance (Comcover) in respect of a broad range of claims, including personal injury, property damage claims, unlawful arrest and detention, and commercial disputes in the Australian Capital Territory and New South Wales courts. Andrew also assists the Department manage its Cornwell-type superannuation claim liabilities.
- Acting for medical professionals in respect of complaints made under the National Health Law and investigated by the Australian Health Practitioner Regulation Agency (AHPRA).
- Advising and assisting businesses and individuals in relation to Australian visas – in particular, the subclass 482 Temporary Skills Shortage visa program, the subclass 186 Employer Nomination Scheme visa program, the subclass 188/888 Investor visa programs, the Partner visa program, and various other work-related visa programs.
