Philip Brown is a Partner in HWLE’s Environment and Planning group and is an Accredited Specialist in Planning and Environment Law.

Philip has specialist expertise in relation to a wide range of issues associated with local government, planning and environmental law and has practiced in the area since 2003

Philip regularly conducts litigation in the Land and Environment Court on behalf of local government and developer clients, as well as providing advice in relation to all aspects relevant to planning, environmental and local government law.

  • Hunters Hill Council Conducting a successful Land and Environment Court criminal prosecution for removal of trees including overseeing the investigation and appearing as advocate.
  • Confidential developer client Conducting Land and Environment Court judicial review proceedings challenging a development consent on neighbouring land impacting upon access, resulting in a successful outcome.
  • Bayside Council Successfully conducting civil enforcement proceedings and subsequent proceedings for contempt of Court in relation to storage of accumulated waste materials on residential land, including appearing as advocate.
  • Bayside Council Advising in relation to various issues associated with Mascot Towers.
  • Hunters Hill Council Conducting a successful class 1 appeal involving traffic safety, heritage, landscaping and height non-compliance issues, including appearing as advocate.
  • St George Bank Advising in relation to contaminated land issues (as mortgagee in possession of contaminated land).
  • Sutherland Shire Council Advising and conducting dispute resolution in relation to an existing voluntary planning agreement including drafting in relation to a further voluntary planning agreement, with public benefits including parklands and playing fields.
  • Hunters Hill Council Successfully obtaining an urgent interlocutory injunction, less than 24 hours after receiving instructions, in relation to the protection of two heritage items which had been/ were anticipated to be the subject of demolition works.
