Hadi Mazloum

Hadi specialises in taxation and commercial disputes. Hadi has represented taxpayers, tax agents and the Commissioner of Taxation for over a decade in debt recovery proceedings, Part IVC proceedings and Family Law proceedings where the Commissioner has intervened.

Hadi’s taxation expertise spans State and Federal taxes including Duties, Land Tax, Division 7A, CGT, GST, capital/revenue, trusts and Part IVA. Hadi also specialises in charities law and has advised and appeared in matters regarding the registration of charities and has particular expertise in respect of the classification of ‘public benevolent institutions’.

Hadi also has extensive expertise in commercial disputes including in insolvency, corporations, contract, trusts and equity and consumer law.

Prior to joining HWL Ebsworth Lawyers, Hadi practised as a barrister at the Victorian Bar for 9 years advising and appearing for a broad spectrum of clients in his areas of expertise.

Experience

Hadi’s experience includes advising:

  • The Commissioner of Taxation in relation to a large scale audit involving complex questions of valuation arising from the capital gains tax regime;
  • A taxpayer in relation to a Part IVA dispute with the Commissioner of Taxation including appearing for the taxpayer at the General Anti Avoidance Rule (GAAR) Panel;
  • The Deputy Commissioner of Taxation in relation to debt-recovery proceedings, including those involving director penalties;
  • The Australian Charities and Not-for-profit Commission in relation to the ACNC’s refusal to register charities as a ‘public benevolent institution’;
  • Numerous liquidators in examinations pursuant to sections 596A and 596B of the Corporations Act 2001 (Cth);
  • An individual in relation to challenging the constitutional validity of the Assisted Reproductive Treatment Act 2008 (Vic) pertaining to access to IVF;
  • A superannuation trustee and public fund in relation to all litigious matters including a dispute arising from a share sale deed as well as numerous breach of contract claims;
  • A registered training organisation in relation to seeking urgent injunctive relief following a decision to suspend its license by the relevant regulator; and
  • Numerous creditors in debt recovery proceedings including against guarantors.
