David Fechter

David Fechter has practised in Corporate and Commercial Law for near 10 years and has worked in a diverse range of matters in his field of expertise. David’s primary areas of focus are his outsourced legal counsel practice and private client practice. In his outsourced legal counsel practice, David advises and acts as in-house counsel for SMEs that have a small internal legal team or no internal legal team as well as undertaking transactional work and providing commercial and strategic legal advice. David’s work involves regularly advising on corporate/commercial issues; advising on tax and revenue issues; drafting and reviewing contracts; advising directors and officers; corporate governance and compliance; and advising and acting on the sale and purchase of businesses/companies and properties. In his private client practice, David provides advice to individuals and families in relation to a broad range of matters including trusts, superannuation, taxation and business succession and estate planning, wealth planning and a range of commercial transactional and advisory work.

David’s client base ranges form SMEs including family businesses, SMEs in the medical and allied health industries, professional associations and medical colleges, high net wealth individuals and families.

David has completed his Masters of Corporate, Commercial and Taxation Law at University of New South Wales with excellence.

Experience

David’s experience includes:

  • A large French client: Acting in relation to the acquisition of 100% of the shares in an Australian company thereby establishing its presence in the Australian market;
  • A high net-worth individual client: Acting in relation to various property interests who died suddenly. During his lifetime we acted in relation to a variety of commercial and property matters including structuring work and we have acted for the deceased estate which involved an intersection of various legal issues including probate/estate work, trusts work, commercial dispute regarding a debt owed by the deceased, advising in relation to loan terms and family provision claims on the estate;
  • Various estate planning matters: Assisting with complex estate planning where the clients have substantial personal wealth and a web of companies and trusts with substantial assets controlled by the client. These often involve sensitive family issues where the client’s children do not always get along;
  • Various trusts and superannuation clients: Advising on numerous trust and superannuation issues including amendments to trust deeds, foreign person issues, extensions to the vesting date, distribution minutes, winding up the trust and resettlement/tax advices; and
  • Various clients and unit trusts: Reviewing and drafting Shareholder and Unit Holder Agreements for companies and/or unit trusts.
