Melissa Hore

Melissa is a Partner in the HWL Ebsworth Property team and has extensive experience practising across all areas of property, franchising and competition and consumer law.

Melissa’s property and development experience includes specialising in both tenant and landlord portfolio retail, commercial, industrial and mixed use leasing and development nationally, across existing assets and new development properties.  She drafts, negotiates and advises on all aspects of leasing matters, including heads of agreement, complex agreements for lease and delivery agreements, leases, subdivision and easements, tripartite agreements and other commercial agreements.  Melissa also specialises in developing master documentation for large mixed use development sites integrated with residential towers and parcels, involving different strata and stratum lots and associated documents.

Melissa established the firms online tenant leasing platform (Tenlease), utilised by clients nationally across the firm, and continues to manage development of Tenlease and the firms online landlord leasing platform (OLP).

She also has experience in a range of franchising and competition and consumer law matters including: franchise agreements and related documentation, ACCC notifications, securing ACCC clearance for mergers, managing the response to ACCC investigations, advertisement vetting and review of sales materials and other matters arising from the Competition and Consumer Act.

Experience

Melissa’s experience includes advising:

  • Competitive Foods/Hungry Jack’s on all of Hungry Jack’s leasing and development matters nationally, including renewals of all stores (a portfolio of over 420 stores nationally), all new developments (including agreements for lease, leases, easements, tripartite agreements and side deeds), advice work and work on other property matters across the Hungry Jack’s portfolio and broader Competitive Foods portfolio;
  • Domino’s Pizza Enterprises Limited on all of Domino’s leasing and development matters nationally (a portfolio of over 375 stores nationally), including renewals, leases, agreements for lease, assignments and advice;
  • Ampol on its successful bid on the TfNSW tender for the Pheasants Nest (M5 northbound and southbound) highway service centres and Eastern Creek (M31 eastbound and westbound) highway service centres and negotiating the pre-commitment delivery agreements and long-term leases for those sites;
  • Coombes Property Group/Challenger joint venture on the development and leasing of a new 35,000sqm shopping centre and separate bulky goods/large format retail centre in Darwin (NT), including negotiation of agreements for lease and leases for all tenancies including Greater Union, Woolworths and Big W;
  • Cbus Property, Newmarket Randwick and The Langston on leasing of the retail precinct of the Newmarket project and The Langston project (both including various retail and residential lots) including preparation of all standard documentation (HOA, lease and pre-commitment agreement for lease, disclosure documentation), involving different strata and stratum lots and associated documents;
  • Drivas Group, Coombes Property Group and Drivas/Telado joint ventures on retail and commercial leasing of numerous properties across both the Drivas Group portfolio in NSW and QLD, the Coombes Property Group porfolio in NSW and NT and the Drivas Group/Telado joint venture portfolio in NSW, including leases, agreements for lease, renewals, surrenders and assignment of leases, signage licenses and incentive deeds; and
  • New South Wales Telecommunications Authority on the negotiation of leases across NSW as part of the roll out of emergency services telecommunication services.
