Anastasia Nekrouchets is a Special Counsel at HWL Ebsworth with over 17 years of experience in litigation and dispute resolution, including alternative dispute resolution with a focus on building, construction and infrastructure.
Anastasia has acted for developers, builders, and property owners in respect to all aspects of building dispute resolution such as variations (including time and delay costs claims), payment claims, termination of contracts, release of security including bank guarantees and various claims in respect to defects. Anastasia also has extensive experience in providing comprehensive advice on claims under the Building and Construction Industry Security of Payment legislation.
Experience
Anastasia’s experience includes advising:
- A major commercial building contractor on recovery of underpayment and return of security where a contract terminated at will by the principal in respect to a $12 million contract;
- A major commercial building contractor in respect to an action brought by the Owners Corporation of a serviced apartment building for claims in respect to major defects that included a claim of over $15 million for rectification costs. The matter involved cross-claims against 13 sub-contractors and issues of duty of care, statutory warranties, liability, insurance liability, weather defects design or construction issue;
- Principal in relation to an adjudication response concerning variations claimed in the amount of $130 million for a major commercial project, under the dispute resolution provisions contained in the contract;
- Numerous developers and builders in relation to claims for variations, extensions of time, delay costs and defects; and
- Various clients in respect to applications under the Building and Construction Industry Security of Payment Act.
