Alan Chiang

Alan acts on all aspects of both small and large scale projects, ranging from tender/procurement through to preparation of construction contracts and contract administration. Alan has broad experience in D&C projects, understanding the key issues of design risk, design intent and appropriate risk allocation for a successful project.

Alan’s ability to manage and lead the successful implementation of projects is not limited to ‘front-end’ construction. His skills and experience extend through to advice work post completion, claims strategy and dispute work where he has practiced across all Victorian Courts and Tribunals.

Experience

Alan’s experience includes advising:

  • Various large international & national contracting entities on drafting and preparing suites of head contract, subcontract and consultancy agreements; drafting and negotiating downstream subcontracts, supply agreements, minor works and services agreements; and contract interpretation and claims advice including adjudication applications/responses, tribunal and court applications and arbitration in construction and infrastructure projects;
  • A major pipeline subcontractor on a private arbitration in relation to a $22 million contractual dispute in Queensland;
  • Various principals and owners (including Councils, Hotels, Manufacturers, Universities, Schools, Charities / Not for Profits and High Net Worth Individuals and Families) on preparing and advising on project and tender documentation (including Requests for Tender, ECI Agreements, Consultant Agreements, Letters of Intent, Supply Agreements, Construction Contracts, Deeds of Novation and Building Tripartite Deeds);
  • Various contractors/builders, subcontractors and consultants on project documentation, including the negotiation of contracts and advising on contract administration, interpretation and claims advice. Alan advises many of the market leaders in the residential building space, including some of Australia’s largest volume home builders;
  • Financiers including both private financiers and major banks (eg Westpac, Bank of Melbourne and Commonwealth Bank) on construction contract review and advice;
  • Various residential property developers on drafting building contracts for various residential developments;
  • Council on preparing tender documentation (including a tender version project agreement) in relation to the construction of a large processing facility; and
  • Various greenfield property developers on drafting and negotiating infrastructure agreements, civil works contracts and building contracts for various greenfield residential developments.
