With just one month to go before the Unfair Contract Terms regime is extended to apply to certain business to business contracts, have you taken the time to assess whether your contracts are at risk of being declared unfair?

From 12 November 2016, the terms of certain contracts may be challenged as unfair. If declared by a court or tribunal as unfair, the term will be void and unenforceable. For example, if sums of money have been charged based on that term, such as cancellation fees, assignment charges etc, then the term being declared “unfair” may result in you having to repay those fees and adversely affect your future revenue.
