Sheldon Garcia

Sheldon Garcia is a Partner in HWL Ebsworth’s Building and Construction group in the Sydney office.

Sheldon’s focus is on dispute resolution and litigation and has worked with a range of participants in the construction industry including builders, developers, building professionals, expert witnesses, strata schemes and proprietors.

Sheldon has been closely involved with the project management and internal legal teams of several major contractors, including being seconded twice to assist in the preparation of significant claims to the principals of the projects. Sheldon has been able to get an insider’s view of how things are done and has been able to develop legal strategies to enable the achievement of commercial objectives.

Sheldon’s work with NSW Government includes a 10 month secondment to the Sydney Trains legal team (commercial and projects) between mid 2016 to mid 2017. Sheldon’s work included advising on procurement and governance issues, assisting in the procurement of goods and services (ranging from $100k to tens of millions), drafting and revising contracts based on the Sydney Trains’ template suite, negotiations with suppliers and contractors and drafting, advising and negotiating with global IT suppliers in relation to Procure IT 3.1 and 3.2 agreements.

Sheldon has over 15 years of experience regarding residential building, building defects, Home Building Act and home warranty insurance disputes and has acted for owners corporations/strata schemes, builders, developers, architects and subcontractors.

Experience

Sheldon’s recent experience includes:

  • Sydney Metro North West Rail: advised the infrastructure joint venture in relation to contractual issues;
  • Sydney Trains: drafted and negotiated a range of contracts; advising on procurement and governance issues;
  • Thiess/CPB Contractors: advised in relation to the design and construction of a pedestrian walkway known as Wynyard Walk from Wynyard Station to Barangaroo;
  • John Holland: advised in relation to the Moorebank Units Relocation project, involving civil and infrastructure works at a military base;
  • John Holland: advised in relation to the construction of a 330kV transmission line spanning more than 100km between Wollar and Wellington in NSW;
  • Residential defect claims: several $1 million plus disputes; and
  • Security of Payment: adjudications and expert determinations ranging from $250 thousand to $20 million.
