Luke specialises in Planning, Environment and Government law with a particular focus on advising and litigating disputes relating to the use of land.
He advises clients in respect of residential, commercial, retail and industrial developments as well as heritage and environmental issues associated with development. Luke acts for clients in appeals and other proceedings in the Planning and Environment and Land Courts as well as judicial review proceedings relating to government decisions, particularly where they affect the use or value of land.
In addition to dealing with merits appeals and judicial review proceedings, Luke also acts for clients in enforcement proceedings and regulatory prosecutions.
Experience
Luke’s experience includes advising:
- Orb Holdings Pty Ltd in respect of litigation in the Supreme Court of Queensland, Court of Appeal and High Court of Australia concerning the historical dedication of roads in the Brisbane CBD;
- Genamson Holdings Pty Ltd concerning the proposed resumption by a local government of part of a shopping centre, which was successfully resisted in judicial review proceedings before the Supreme Court of Queensland;
- Mirvac Limited in respect of litigation in the Planning and Environment Court and the resolution of infrastructure issues concerning a large master-planned residential development;
- City Developments Limited concerning changes to a large master-planned apartment and townhouse development on a State Heritage Place; and
- Abacus Property Group in respect of multiple submitter appeals concerning a large master-planned development on a site in Brisbane.
