Lex Holcombe

Lex advises on government law. He has particular expertise in relation to freedom of information and privacy, statutory interpretation, administrative law (advising and litigation) governance and regulatory programmes.  He also advises entities on FIRB applications, autonomous sanctions and compliance with environmental laws.

Lex has extensive experience in helping agencies develop programmes and implement government initiatives, including drafting of legislative instruments and the review of existing programmes.

Lex has been named in Best Lawyers™ for Public Law.


Lex’s recent experience includes:

  • Department of Education and Training: Acting for the Secretary in AAT litigation in relation to applications for re-crediting of FEE-HELP balances.
  • Department of Environment and Energy: Acting for the Minister in Federal Court challenges to EPBC Act approvals;
  • Office of the Australian Information Commissioner: Acting in Tribunal and Federal Court challenges in relation to Privacy determinations and FOI decisions;
  • Office of the Australian Information Commissioner: Drafting APP codes, including the Explanatory Statement and Compatibility Statement;
  • Western Australian Parliament: Advising on the validity of amendments purported to have been made to model legislation and whether those amendments had been made to the WA legislation; and
  • Foreign investors: Advising on significant acquisitions by foreign investors of commercial property, rural property and residential property in relation to FIRB approval under the Foreign Acquisitions and Takeover Act 1975 (Cth).
