Karen Fairbairn

Karen is an expert adviser on all aspects of the Personal Property Securities Act (PPSA).  She brings over 25 years experience in banking law and regulation and 9 years experience in investment and commercial banking to HWL Ebsworth, including a rich knowledge of the PPSA, gained from an 18 month role as legal counsel to Westpac’s PPS Reform Program.

Karen acts for insolvency practitioners in dealing with the claims of secured creditors.  She assists corporates across all industry sectors to establish or consider the appropriateness of their PPSA strategy.  She helps financiers to deal with actual and potential priority disputes and other PPSA-related matters.

Karen regularly gives presentations and seminars and publishes articles on PPSA issues.


Karen’s recent experience includes:

  • Large construction company: Advising on the PPSA implications of undertaking major construction projects;
  • Howards Storage World, Plaza Home Imports, Hungry Jack’s Australia and Tarkett Australia: Acting on the protection or enforcement of retention of title security interests;
  • Major Australian vehicle leasing company: Acting in relation to its claims against the Liquidators of Tieman Industries Pty Ltd for conversion, trespass and detinue;
  • Westpac, ANZ, Commonwealth Bank and Macquarie Bank: Acting on the enforcement of security interests; and
  • Receivers, managers and administrators: Acting for the Receivers and Managers of Bias Boating Pty Ltd, the Administrators and Liquidators of Mining Management Group Pty Ltd and MMG Drill & Blast Pty Ltd, the Administrators and Liquidators of the Animal Supplies group, the Administrators and Liquidators of the Sebel Furniture group, the Administrators and Liquidators of the Bubs Baby group, the Administrators and Liquidators of Willow Ware Australia, the Administrators and Liquidators of Spectrum Community Outcomes and Spectrum Community Focus and the Liquidators of Myzac Constructions.
