Fergus Beams

Fergus is a Special Counsel in HWL Ebsworth’s Dispute Resolution Group. He is highly experienced in complex commercial disputes across multiple industry sectors and practice areas including corporations, equity, property, contract, white collar, and regulatory investigations and disputes.

Prior to joining HWL Ebsworth, Fergus gained excellent experience at leading national and international law firms in Australia, and as a principal litigation lawyer and manager at a Commonwealth financial services regulator.

Fergus enjoys getting to the core of complex legal problems quickly, assimilating the real commercial context in which his clients operate, and providing them with practical solutions. In doing so, he fosters a team approach with clients, in-house counsel, colleagues, and members of the Bar.

When litigation is necessary, Fergus is known for the clarity of his legal analysis, the thoroughness of his evidence preparation, his capacity to articulate his clients’ interests, and his determination to fight for them.


Fergus’ recent experience includes advising:

  • A prominent international media business, and its CEO in response to breach of contract and misleading and deceptive conduct claims;
  • Directors of a corporation in response to breach allegations in connection with alleged offshore tax scheme;
  • A property development company in a multi-party dispute involving a commercial counterparty and caveator lessee;
  • A market-leading food manufacturer in a claim against a supplier of defective industrial machinery;
  • A primary producer in the luxury food sector in a claim against an energy distributor;
  • A major ADI on preparing directors and business SMEs for an in-depth regulatory review;
  • A Commonwealth regulator on claims for breach of continuous disclosure obligations;
  • A Commonwealth regulator on lawful and appropriate use of powers in the investigation and enforcement context, particularly in superannuation and banking; and
  • A national charity in response to an investigation by a regulator.
