David O'Farrell

David has over 25 years experience as a corporate and financial dispute resolution lawyer with particular expertise in reconstruction and insolvency.

David has extensive experience in both contentious and non-contentious matters. He has represented a wide variety of stakeholders in distressed financial circumstances including secured financiers, debt and equity participants, directors, insolvency practitioners and regulators. He has been involved in several of Australia’s most complex insolvencies and restructures (both public and private) over the past 2 decades.

David is committed to working closely with his clients and key stakeholders so as to understand their objectives and sensitives. His preferred approach involves providing guidance about and agreeing on an early strategy to achieve the best available outcomes.

David is a Fellow of the Australian Reconstruction Insolvency & Reconstruction Turnaround Association (ARITA) and has been long-standing committee member and former Vice-Chairman of the ARITA Queensland state committee, and he has assisted in the conduct of ARITA disciplinary proceedings.

David is currently (and has for some years) listed as a ‘Leading’ Lawyer in the categories of Insolvency & Reconstruction and Commercial Litigation & Dispute Resolution by Doyle’s Guide, and named in Best Lawyers™ Australia for Insolvency and Reorganization Law. He regularly presents on current topics relevant to insolvency & reconstruction, as well as dispute resolution.

Experience

David’s experience includes advising:

  • Queensland Nickel Pty Ltd in relation to the high-profile liquidation of Queensland Nickel Pty Ltd;
  • Skytrans Pty Ltd on the voluntary administrators of Skytrans Pty Ltd, Queensland’s largest regional airline. The airline was restructured, via a Deed of Company Arrangement and Creditors Trust, including the novel result of preserving the Air Operating Certificate;
  • Queensland Statutory Body in relation to the contested termination, and ultimate settlement, of a substantial GITC Framework Information Technology contract;
  • Commonwealth Bank of Australia (CBA) in relation to the realisation of securities over the Hervey Bay Resort, and acting in contested proceedings for enforcement of guarantees; and
  • HIH for the liquidators of the HIH group of companies, including in relation to the development and implementation of creditors’ schemes of arrangement.
