Daniele practices in all aspects of commercial litigation, reconstruction and insolvency with particular emphasis on contractual disputes, corporate fraud and director and shareholder disputes.
Daniele’s recent experience includes:
Insurance company: Acted for an insurance company in relation to the misappropriation of $17M by its employee claims officer including obtaining Anton Piller orders, freezing orders and recovering assets;
Bank: Acted for a banking client in relation to a fraud by its employees, including engaging forensic accountants and forensic IT experts and issuing proceedings for recovery of assets;
CHEP Australia Limited: Acted for CHEP Australia Limited in proceeding in the Supreme Court of Victoria involving breach of contract and misleading and deceptive conduct;
Investor: Defending a challenge by an investor on the validly a managed investment scheme under section 601MB of the Corporations Act based on a alleged failure to disclosure commissions and conflicts of interest in its product disclosure statement; and
Publicly listed company: Advised a publicly listed company and its subsidiaries in relation to solvency issues arising from regulatory and other legal action commenced against the group.
