Brooke Jacobs

Brooke has practiced for in excess of 15 years in the field of defendant insurance work in Queensland, including general insurance, workers’ compensation, product and public liability, marine and professional indemnity. Her clients have included insurers, employers, mines, construction companies, service providers, shopping centres, licensed premises and local authorities, among others.

Brooke has provided advice and had the conduct of matters concerning complex and novel insurance issues, including consideration of statutory, domestic, commercial and industrial policies in the context of significant claims, coverage issues, dual insurance, non disclosure and underinsurance.

Brooke is well versed in managing successfully to conclusion multiparty claims and claims involving significant liability, quantum and factual and medical causation issues.

Brooke’s experience includes advising:

  • Labour hire provider in relation to contractual indemnity and breach of contract for failure to insure claims brought by the host employer;
  • Construction company by representing an insurer in relation to a claim for damages for catastrophic personal injuries involving multiple parties, expert engineering evidence and indemnities up and down the contractual chain;
  • Mining company on the management of large portfolio of workers’ compensation claims involving everything from catastrophic physical injuries, including burns, electrocution or amputations, as a preferred provider;
  • Employer in relation to an uninsured contractual indemnity claim by a principal and defending court proceedings successfully to the point of a ‘walk away’ compromise; and
  • Private client on successfully suing an insurer on behalf of a private client who suffered significant property and financial losses arises from a fire event resulting in the insurer completely indemnifying the client for the full extent of the claim, interest and costs.
