Brian Rom

Brian is a disputes lawyer specialising in complex construction matters. Having acted for domestic and international clients, Brian has significant experience in high value arbitrations, court proceedings, expert determinations, adjudications and mediations – always underpinned by a prudent legal strategy. His disputes experience extends to oil and gas, renewables, shipping, mining, logistics, property and fraud matters. Along with his disputes experience Brian also has drafted all forms of construction contracts.

Brian is a regular speaker on construction law and general contract related topics.

He has practiced in the UK, South Africa, New South Wales and Victoria. Prior to moving to Australia in 2008, he working in London for eight years on multi-jurisdictional arbitrations and court proceedings.

  • State owned oil company in an international arbitration involving the termination of the charter of an FPSO on the grounds of numerous technical defects;
  • Barge designer and operator in court proceedings concerning a claim by oil company for defects in the design of the barge;
  • Design joint venture in an adjudication concerning the City Link Tullamarine widening project;
  • Top-tier engineering firm in multi party court proceedings concerning defects to concrete structure of a state-of-the-art aquatic centre;
  • Top-tier contractor in regards to advising on, and drafting, contracts for major road and rail infrastructure projects across Australia;
  • International agribusiness drafting a full suite of contracts for grain silo facilities in Western Australia and Victoria; and
  • Wind-farm installation contactor in regards to reviewing and amending construction contracts and framework agreement for wind-farm projects across Australia.
