Brendon Clarke

Brendon specialises in large-scale, complex disputes involving in-depth forensic investigation and analysis.

He has acted on a broad range of commercial litigation and regulatory investigations, and has advised clients in sectors including banking and finance, energy and resources, construction and engineering, property, IT, telecommunications and Government.

Brendon has been involved in several high profile legal proceedings in both Australia and New Zealand.


Brendon’s experience includes advising:

  • National Australia Bank in connection with regulatory investigations, including by way of a full-time secondment to NAB’s in-house legal team;
  • A major resources company in proceedings challenging an ATO decision disallowing deductions in excess of $70million;
  • A listed AFS licence holder in connection with regulatory investigations and enforcement action by ASIC in connection with alleged non-compliance with the National Consumer Credit Protection Act;
  • A major Australian bank on high profile proceedings in Victoria and Western Australia arising out of the enforcement of security associated with a substantial industrial plant;
  • An oil exploration company on separate judicial review proceedings relating to decisions of a Government Minister and a Government agency; and
  • A major retail franchisor on a claim for misleading and deceptive conduct against a global software company relating to the development of software systems.
