Tom Wilson

Tom has 12 years experience in commercial disputes & litigation with the last 3 years focussed solely on disputes in the construction industry. Prior to becoming a lawyer, Tom worked for a property development firm for 5 years in project and finance management.

Tom has spent the majority of his legal career working on large and complex disputes related to a number of substantial projects and developments in Western Australia.

More recently, Tom has acted for various head contractor, subcontractor and developer clients in relation to issues arising under construction contracts and on a number of adjudications under the Construction Contracts (Former Provisions) Act 2004 (WA).

Experience

Tom’s experience includes advising:

  • John Holland Pty Ltd in respect of the circa $200 million Supreme Court litigation against the WA State government related to the construction of the Perth Children’s Hospital;
  • Westgem Investments Pty Ltd in large-scale litigation against the CBA, Bankwest and BOSI related to the Raine Square development;
  • Firm Pty Ltd (in administration) with respect to termination of a number of construction contracts and issues with the management of Project Bank Accounts;
  • A WA state government corporation in relation to its dispute over the scope of works in a contract for remediation of contaminants from a future development site; and
  • A WA local government with respect to defects in renovation works undertaken at a large aquatic facility and rectification of the same.
