Simon Walsh

Simon advises clients on the procurement and delivery of construction and infrastructure projects.

Simon works on a range of projects, including across road, rail, water, energy, health, education, airports and non-residential building sectors for Governments, private sector principals, contractors, developers and service providers. Simon has experience across all major forms of contracting, including design and construct, construct only, O&M, facilities and asset management, managing contractor and PPP transactions, as well as wide a range of interface, consultancy, complex services, standing offer and other commercial agreements.

Simon was recognised as a “Construction/Infrastructure Law Best Lawyer” in the 2021 Best Lawyers List and a “Recommended Leading Front End Construction, Infrastructure and Major Projects Lawyer” in the 2021, 2020 and 2019 Doyle’s Guide. Experience

Simon’s experience includes:

  • Schools Infrastructure NSW (Department of Education): Advising on all aspects of SINSW’s $6billion+ new and upgraded schools program, including acting on major procurements (such as the new Inner Sydney High School; Western Sydney & Wollongong Schools Package 1; Meadowbank Education Precinct) and development of updated Template Contract and Tendering Terms based on GC21 for application across the Program (including D&C, ECI, Panel and Standing Offer Contracts) and advising on delivery phase matters across the portfolio;
  • Sydney Metro Projects: Advising bidders on the Sydney Metro Central Tunnelling Package; Sydney Metro Western Tunnelling Package and Sydney Metro Western Sydney Airport SSTOM PPP in respect of a variety of agreements, such as D&C (including with incentivised target cost arrangements), Delivery Partner agreements, O&M agreements, JV agreements, Managing Contractor arrangements, interface deeds and consultancy contracts.
  • Department of Defence: Advising the Commonwealth on a range of Defence infrastructure procurement projects, including design and construction of works at critical Defence facilities in NSW, Victoria, Queensland, Western Australia and the Northern Territory across various project delivery methods and contracts (including DSC and HC, MWC and MCC);
  • NSW Health: Advising on the procurement of 7 new highly specialised fixed wing air ambulance aircraft, together with long term operation and maintenance services for NSW Ambulance. Simon led a multidisciplinary team advising across all aspects of project planning, financing, procurement and delivery of these critical assets, to enable NSW Health to provide equity of access to healthcare to critically ill and injured patients across rural and regional NSW;
  • Western Sydney Airport: Advising Western Sydney Airport Co Limited on rail and road interface arrangements in respect of the new Western Sydney Airport, to facilitate operations from 2026;
  • Water Utilities Australia: Advising on recycled water projects, in particular relating to WUA’s purchase and operation of the AquaNet Rosehill Recycled Water Scheme and the Kooragang Island Recycled Water plant upgrade projects, as well as customer connection and relocation projects.
  • Transport for NSW (TfNSW): Advising TfNSW on various D&C packages and commercial contracts (electronic tolling); Advising TfNSW as in-house counsel on the delivery phase of the $2.1billion Sydney Light Rail PPP;
  • Emergency Services Agencies (including NSW Police Force; NSW Rural Fire Service; NSW Ambulance; Queensland Police Service; Queensland Public Safety Business Agency): Advising on a range of major complex procurement and delivery issues including procurement of specialised major equipment; COVID emergency response matters; contract administration and delivery phase advice; and procurement of facilities maintenance, capital works and other asset management services for the entire NSW Police Force property portfolio;
  • Sydney Motorway Corporation: Advising on the procurement and delivery of the $16.8billion WestConnex Motorway Project, including Project Deed, D&C, O&M and tolling arrangements; and
  • Roads and Maritime Services (now TfNSW): Advising on the procurement and delivery of a number of road projects including the M5 West Widening PPP Project ($400million) and D&C upgrades to the Pacific and Princess Highways (in excess of $2billion).
