Simon Crawford

Simon acts for a range of banking and financial services organisations and corporate clients providing legal advice across issues relating to fraud and forgeries, breach of contract, misleading, deceptive and unconscionable conduct. He has gained his expertise from over 20 years experience in both private practice and as a Deputy General Counsel at a major Australian bank.

Simon also advises and acts in trusts and wills and estates litigation. His clients include large charitable institutions and Trustee Services companies.

A skilled negotiator, Simon has participated in numerous mediations and has completed a 5 day Mediation workshop conducted by LEADR, the first step towards achieving national specialist accreditation in mediation. Simon is a member of the Alternative Dispute Resolution Committee, Litigation Section of the Law Institute of Victoria.

Experience

Simon’s experience includes advising:

  • ANZ Bank on legacy litigious exposures in India in relation to Grinlays Bank;
  • Former Trustees in relation to Supreme Court litigation (Wales v Wales);
  • A number of defendants who successfully defended proceedings brought by ASIC in the Federal Court for alleged involvement in the issuing and sale of binary options without a Financial Services licence (ASIC v One Tech Media Limited and Ors);
  • A defendant who successfully defended a Supreme Court application for leave to bring a derivative action (Atwell v Melbourne Serviced Apartments Group Pty Ltd and Ors); and
  • Berndale Group of companies (liquidators) in public examinations of a number of former directors and other persons associated with Berndale Capital Securities Pty Ltd (In Liquidation) and other companies in the Berndale Group.
