Daniele specialises in commercial litigation and insolvency with particular emphasis on contractual disputes, corporate fraud, regulatory compliance and enforcement and director and shareholder disputes.
Experience
Daniele’s experience includes advising:
- An insurance company in relation to the misappropriation of $17 million by its employee claims officer including obtaining Anton Piller orders, freezing orders and recovering assets;
- Thunder Road Brewery in an intellectual property dispute brought by Stone & Wood over the name Pacific Ale (the outcome was successful);
- Landlords and tenants regarding their rights and obligations under the COVID-19 Omnibus (Emergency Measures) Act 2020;
- A publicly listed company and its subsidiaries in relation to solvency issues arising from regulatory and other legal action commenced against the group; and
- Directors and companies on obligations under the Corporations Act and in connection with directors’ disputes, shareholder oppression proceedings and claims for breaches of directors’ duties and other fiduciary obligations.
