When managing the return of employees to the workplace after they have been absent due to illness or injury, do employers have the right to direct employees to undergo an independent medical examination by an employer nominated doctor, particularly when they have concerns for the health and safety of employees?

The Minister for Employment, Senator Michaelia Cash, introduced the Fair Work Amendment (Protecting Vulnerable Workers) Bill 2017 (Amendment Bill) on 1 March 2017. The Amendment Bill contains elements of the Liberal Party's "Protecting Vulnerable Workers" Policy that was released just before, and taken to, the last Federal election. The Amendment Bill delivers on an election commitment to ensure workers are protected from exploitative and unfair practices in the workplace.
