We provide extensive legal services relevant to the water industry, and particularly with regard to major water infrastructure projects (such as dams and pipelines), regulatory advice, supply and transportation arrangements and water trading.

We have a unique perspective on water issues. Our partners have advised both private sector and government owned entities in relation to water infrastructure projects. Our knowledge of the regulatory framework of the water sector in Queensland is based on transactional and industry experience. This depth of experience ensures that we have superior understanding of the key legal, commercial and operational issues affecting the water industry.


Our relevant experience includes acting on the following matters.

  • Queensland State Government Department – Coal Seam Gas Water: advised a Queensland department and a local Queensland Council in its negotiations with a coal seam gas provider for the supply of coal seam methane water for use as a potable water supply.
  • Eastern Pipeline Alliance: in this matter we were involved with the major alliance negotiation in respect of the Western Corridor Pipeline Development. We provided our client with alliance project management advice and strategic advice as to the conduct of negotiations. The project involved the construction of a $300 million pipeline linking the Hinze Dam with the Wivenhoe Dam.
  • South East Water Alliance: advised on the formation of an alliance for the long-term provision of operations and maintenance services and capital works. This involved participating in the selection and commercial workshops, the development of the commercial structure of the alliance, drafting and negotiation of the alliance agreement, reporting to and advising the SEW board. Advised on governance issues associated with the alliance and on legal issues associated with the use of the alliance method of procurement, including the application of provisions of water and water industry legislation.
  • Murrumba Downs Wastewater Treatment Alliance Project: we were retained by John Holland to assist them in the preparation of their bid for the Murrumba Downs Wastewater Treatment Alliance Project. We advised John Holland, one of the bidding consortia, as to preparation and the terms of the bid proposal and the risk reward matrix for the alliance. The alliance will deliver for the Pine Rivers Shire Council an upgrade of its wastewater treatment plant to a contract value of approximately A$60 million.
  • Major Oil & Gas Producer - Beneficial Use & Discharge of CSG Water: advised a major oil & gas producer on discharge of CSG water for benefit of downstream irrigators and a major bulk water service provider including compliance with the relevant Environmental Authority and CSG Water Management Plan. Advised the client in relation to discharge of CSG water to dams for irrigation and dust suppression purposes and requirements for Beneficial Use Approval. Advised the client on use of water for domestic purposes.
  • Major Oil & Gas Producer - Transport of CSG Water and Regulated Wastes: advised a major oil & gas producer on transportation of CSG water via pipeline across Authorities to Prospect. Advised the client on the transportation of regulated waste, including CSG water and other wastes, across Petroleum Leases. Advised on regulatory compliance issues associated with amendment to the client's Environmental Authority. Advised on acceptable use of CSG water within bounds of Petroleum Lease and Authority to Prospect.
