We understand the complexities of the legislative framework in respect of the regulation of the onshore and offshore petroleum and gas industry at both a State and Commonwealth level.

Our national oil and gas team has extensive experience in providing advice to major producers, distributors, retailers and customers on a range of different and complex issues relating to the grant and operation of tenements, upstream exploration and production activities and the processing, transportation, distribution and sale of petroleum and gas both in Australia and internationally.

We have advised both sellers and purchasers on a range of complex and unusual gas transportation arrangements and connection agreements underpinning the sales process.

Our expertise extends to advising on joint venture and joint operating arrangements, royalty agreements, land access and compensation issues, the emerging greenhouse gas storage legislation and advice on water rights affecting petroleum tenures.

Expertise

Our relevant experience includes acting on the following matters.

  • Gladstone LNG Pty Ltd: Andrew Bruton advised a subsidiary of a large publicly listed company on aspects of the development of Queensland’s first LNG project at the Port of Gladstone. The proposed project is a mid-scale (up to 3.0 million tonnes per annum) liquefied natural gas production plant to be located on Fisherman’s Landing and linked to a 450km gas pipeline from Queensland gas fields. The development costs for the first train of the project (a 1.5 million tonne production facility) will be US$500 million. Andrew advised on key early works contracts for the site and on complex due diligence of critical upstream coal seam gas assets necessary to underpin production.
  • Origin Energy Limited: advised Origin Energy Limited on numerous wholesale gas sales contracts with multiple counterparties throughout Queensland.
  • ENERGEX Retail Pty Ltd (Major Coal Seam Gas Sale Agreement): advised ENERGEX Retail Pty Ltd in its negotiations with Anglo Coal for a major coal seam gas sale agreement which formed a significant part of ENERGEX’s gas portfolio in Queensland at the time. This was one of the first major CSG sale agreements negotiated in Queensland. The agreement was recently litigated between Anglo and the successor to ENERGEX's gas business in Queensland (AGL) in respect of issues concerning force majeure and reserves forecasts. The matter was decided by the Supreme Court in favour of AGL.
  • CS Energy Limited (Coal Seam Gas Supply Agreement): advised CS Energy Limited in respect of a Gas Supply Agreement with Arrow Energy for coal seam gas.
