Traditionally, the appetite for asset and structured finance transactions is driven by market and regulatory circumstances at the time. For example, Basel III is set to influence the business models of asset-based financiers, both regulated and unregulated.
Our team offers over thirty years' experience of structuring solutions and legal knowledge to adapt to new scenarios and business needs.
We have advised on a broad range of transactions including finance and operating leases, leveraged leases, cross-border leases and complex tax based structures.
Members of our team have acted for arrangers, lessees (both government and private), lessors, financiers and sponsors and have been closely involved in the planning, structuring and documentation of these transactions. Assets financed include power stations, aircraft, rolling stock, transmission wires, rail track, software, real estate, research and development assets and shares.
Naturally, our finance specialists work closely with our tax team who assist in all aspects of these transactions.
Our relevant expertise includes:
- documenting and negotiating over 30 leveraged leases and over 20 research and development syndicated transactions;
- documenting and negotiating numerous USA/Australian and Swedish/Australian cross-border lease transactions relating to power plants, rolling stock, aircraft and other assets;
- documenting tax effective concurrent lease transactions for real estate assets; and
- preparing standard form lease and hire purchase agreements for a number of lessors.
